Trademark Filing For Hong Kong
Filing Requirements:
- Name, address and description of the applicant. (in the case of a corporate applicant, the place of incorporation); in the case of partnership, names of 2 to 3 partners who have been authorized to represent the partnership (please note that the certificate may then be issued in the name of those named partners only); names of individuals must be entered in full and the family name underlined.
- A representation of the trademark depicting the trademark clearly. if color claim is intended and in sufficient detail to permit a proper examination to be made of the trademark and being of a kind and quality that is suitable for reproduction and registration.
- The goods and/or services to be applied for. Mmulti-class applications are allowed and the classifications shall be in accordance with the International Classification in force on the date of application), and, if the entire class of goods or services is to be applied for (note: if specification is too vague, no filing date will be assigned), the precise goods or services of interest in the event that the Registrar queries the same.
- Confirmation that the trademark is being used by the applicant or with his consent in relation to the applied for goods or services or the applicant honestly intends to use the trademark, or allows it to be used, in relation to those goods or services.
Priority Document:
Details of the priority application if convention priority is claimed (including the name of each country, the date of filing in such country and the application number assigned).
A certificate issued by the registering or other competent authority regarding the priority application shall be filed upon notice given by the Registrar.
Note: If the mark is in a language other than English or Chinese, the meaning of the mark or its nearest equivalent English word.
Although not required for filing, the following information will assist us in considering whether or not any objection can be overcome by use or prior rights can be claimed in the event of a cited application:
(a) the dates of first use of the mark in the country of origin and in Hong Kong
(b) countries where the mark is registered
(c) promotional and advertising materials showing the use of the mark.
