Trademark Filing For Malaysia

Filing Requirements:

  • Full name and address of the applicant. If the applicant is a partnership, please provide the full names of all the partners.
  • A clear representation of the mark, which can be photocopied. If the representation of trademark is in color, please provide 20 color prints.
  • List of goods or services in respect of which the application is to be filed.
    Note: These goods/services must be classified. Goods are classified according to the International Classification of Goods, whilst services are classified according to the classification recommended by the World Intellectual Property Organization (WIPO). Please note that separate applications must be filed for goods or services, which fall within more than one class.
  • If the application contains or consists of a word or words in  non-Roman characters or in a language other than English or Bahasa Malaysia, a certified translation and transliteration, as appropriate, must be provided.

Priority Document:

  • If the applicant intends to claim a priority date for the filing of an application based on a prior application in a Convention country or prescribed foreign country, the application form must state the relevant Convention/prescribed country and the priority date claimed.
  • A copy of the application filed in the Convention/prescribed country, which forms the basis of the priority claim, upon which the date of that application is shown. Please note that priority based on a foreign application may only be claimed within 6 months from the date of that foreign application.
  • Date of first use of the mark in Malaysia.
  • Applicants are advised not to enter a date of first use on their application form unless certain of this date. Applicants will not be prejudiced by a non-entry of the date of first use on their application form.
