Excellent invention!!!?

By Yahoo User • Category: Patents in China

Now that I have your attention, what would happen if I used something such as vinegar, or paper in my invention? Aren’t those ideas patented? What about plastic bags of some sort? Can I use this stuff to make something else, or will I be violating their patents? The next question is, how can you get somewhere like China to make your product for youThe invention is in the USASo if I were to buy guitars from Ibanez, add some weird feature onto it, and sell it for half the price ibanez sells it for (basically making the guitar kick ass for a lower price), It would be legal? What if I have an idea that can be made fairly easily? I just need to combine existing products to make it work? Say I combine vinegar and toilet paper to create a new combustion engine, and sell it. Is that legal or do I have to consult with them first?

  1. I see you made a change. Thanks. You can use any raw materials available as long as they are not duplicated. By using a plastic bag in its present shape and form but adding something to it will be called a modification of the bag. The modification would have to be approved by your Secretary of State or the US Patent Office. This rule applies to anything that is licensed for sale and approved.

  2. You can certainly use the materials, because even if a substance has ben patented, when you purchase it commercially, the subsequent use does not violate the patent. Paper and vinegar, for instance, are not patented per se.In production, you will find it cheaper to make your own plastic bag, as an example, than to buy it premade by someone else. The Chinese consulate has a staff of people whose job is to help American producers coordinat with Chinese production to make goods. They will be delighted to help you.

  3. Got to a patent agent or lawyer, pay to have the research done and then decide if you want to pursue your idea. A company that makes plastic bags might be thrilled to have their product used in your new product idea!

  4. You have to have permission to use anything that you are not manufactoring yourself. They usually expect a royality.Your along way from hiring a factory. You need your prototype made, and all of the machining for the product worked out before you start looking for a factory. Unless you have a LOT of capitol you are better off getting a venture capitolist company involved.
