Can a phrase from a song be used on something without infringing copyright?

By Yahoo User • Category: Patents Registration

For example. If I wanted to use the words “the eye of the tiger/ the thrill of the fight” on a pair of boxing gloves. Is it is necessary toa) seek permission from the “copyright owner”b) if no permission sought - still acknowledge artistc) is this is any differnt to reproducing the song in whole?someone has said they are just general sentences that could be said by anyone and as long as they are not taken out of context its ok?The site http://www.copyrightservice.co.uk states”There is no copyright in a name, title, slogan or phrase. These may however be eligible for registration as a trade mark. For more information contact the Patent Office”

  1. The general rule of thumb is if the phrase is a key phrase (such as this IS) and if your use of it is likely to be considered to BE infringement to the detriment of the owner of said lyric.:-)Personally, and I am really keen on copyrights as I am a copied designer, I think you are not “harming” anyone. And if you are not making more than a pair for personal use…

  2. Different provisions apply if you are using the phrase on an item you are selling for profit or if you are simply putting the phrase on a pair of boxing gloves you use when you are fighting. The general rule is that if the phrase is generally identified with one particular song, it would be a violation of copyright to use it without permission. Usually, if no profit is involved, or widespread public use, it’s not worth the effort for a company to get involved. But if you are selling the gloves, or if you are boxing for profit or a fee and using them in your glove, then you would be liable and they might well come after you. NFL went after several local churches that wanted to have people watch the Superbowl on a wide screen tv - not allowed if the screen was more than 51″.

  3. I shouldn’t have thought so! You cannot copyright a phrase.Someone wrote a song called ‘I’m A Fool To Care”. Does that mean I cannot have those words printed on my sweatshirt? No way, Pedro!
