If I don’t want anyone else to use the business’s name, do I need a trademark or a service mark?

  1. You may need a trade mark so no one else can use the name you create for your business. What you can do is go to this website (www.secureyourtrademark.com) and learn how you can secure your name with a legal trade mark. Hope the info help you out.

  4. Go to http://www.uspto.gov the US government site for patents and trademarks. They have there all of the information you’ll need to file a registered trademark for the name. In the meantime, use the TM symbol after the name and be sure to add the wording “xxxxxx is a trademark of YOUR COMPANY”Good luck

  5. Yes you do….There is a good Y!A member whose business is entirely involved in these issues. Her ID is TM Express… and she should be on the TOP CONTRIBUTOR lost of this category, if not 2nd from the top..I’ve seen her answers for well over a year.. and they are informative and specific as to resources you need, PLUS her company can do the filings as well, if needed….

  6. You need to check if the domain name is availble first, the register it ASAP. Good name have no domain name would be less effective. Once you can lock in domain name and trade mark or register company at the same time would be ok. Nothing else you can register LLC with domain name in place, would be very cost effective if you would register LLC yourself online or walk in to the state corporate office.Best of Luck
