VHS to DVD public services legal, or illegal? Please help!(USA)?

Hey guys.Is it legal or do I need some kind of permission to record Home Movies VHS tapes to DVD for the public?note- this would NOT be copyrighted material, period.However, I want to make sure I wouldn’t be breaking any kind of law.

  1. If I understand you correctly, you ask whether there is any law against transferring non-commercial VHS movies to DVDs? Assuming you own the equipment and materials to do the transfer and you own the rights to the VHS movies, there should be no problem.The only problem with transferring media from one source to another is that people do it with materials that they do not own the rights to– like movies from Blockbuster. If you make a video recording onto VHS, you may do whatever you want with it.

  2. It is, as long as they provide the orignial VHS and you copy it to DVD, and then destroy the VHS. You can do this with copyrighted material also. The law also a person to make copy for themselves, and not for sale. ie they bring Ghostbusters on VHS to you and ask to have it back on DVD. You can do this, but you must destroy the VHS copy in order to comply with copyright. This is done because if you give both the VHS and DVD back, you’d be violating copyright since they are legally entitled to one copy of Ghostbusters, and if you gave both back you’d be violating copyright since there would now be two copies instead of one.
