Is it illegal in Australia to mod an Xbox?

Don’t talk to me about modifying a toaster. Please refer to relevant copyright / intellectual property law. I am aware of the Sony case in the High Court - I am not convinced that this case means it is okay for Xboxes because they are built differently. Again, don’t just say “I’m allowed to mod because I bought it and I can do what I want with it.”If relevant, please make reference to the Microsoft License Agreement, which all Xbox users allegedly agreed to.Pretty much, what I want to do is turn my Xbox into a jukebox. I want to rip my CD collection onto it (copyright laws in Australia will be amended soon to make format shifting permissible). However, in order to fit my collection on there, I need to change the size of the harddrive. I understand the only way to do it is to add a modchip to allow the Xbox to recognise the new drive.I do not want to play games on it, pirated, legit or anything.I don’t care about the warranty.I am not concerned about the law regarding piracy. It is abundantly clear that that is illegal. I want to know about the law surrounding the installation of a modchip, running the Cromwell BIOS and Linux.

  1. ummmm i dont know about it in australia but in USA its illegal.. to use it that is.. they cant do anything if u have any in ur possesion… and uhh tahts all dont wanna say sometihng that gets me into trouble lol

  2. By mod, do you mean like cheating modding? Like what people do on Xbox Live? If so, I don’t think it’s illegal. Many people do it and nothing happens. If you do get caught for the cheating thing, they just ban or take away your Xbox Live. Thats why people use 2month free trials so if they get banned it doesn’t ban their good account. Beware, this might fry your Xbox

  4. It is illegal to alter the xbox in any means, for any purpose, other than what it was intended for…playing games…if you mod to enhance game play…its ok….if you mod it to copy games, and dvd’s…its illegal…

  5. I see no reason why the Sony case shouldn’t apply to Xboxes as well. The only reason Xboxes would be different is if the hardware contains a ‘technological protection measure’ unused by the PS2, that the courts haven’t ruled on yet. Even then, the default would probably be ‘legal until the High Court overrules it’.Don’t take my word for it, though. I just wanted to get my 2 cents in.

  6. It is probably illegal, but I wouldn’t worry about it. You are not playing illegal or pirated games. Plus, what is the actual probability that you woud get caught for something that small. Especially if you are not even pirating the music, you are ripping from your own collection right?

  7. You can mod your Xbox. It is not illegal, but it will void your warranty. Besides, no one really cares if you have a modded videogame console or not. I have my GameCube modded to read Japanese and American game discs. I’m running the Evolution-X mod on my Xbox. And if there was a way that I knew of for modding my GBA, I’d probably do that too.
