Domain name’s that have to do with a band.?
By Yahoo User • Category: Trademarks LawsuitI run a forum and I have to change the name because it includes the band’s full name. The forum is THEUSEDNEWS and the band is THE USED. I want to change it to GetUsedNews. Would they still be able to have that somehow hold up in any type of court because of the word ‘USED’? The bands full name is THE USED and that is whats trademarked, so if we just use USED then I think everything should be A-OKAY but I need to make sure. Id like to add that the owner of the site (the one who pays for the domain) is worried about the possibility of a lawsuit. I, however, am not. The band have never pressed us or anyone ever about domain names or uses of them. We just cant find a name that accuratly shows what we do there, that also notes what the site is about.PLEASE HELP! (unsure where to post this).

this is not really a court issue, but one of ICANN, whch administers all domains worldwide. I am sure your reigistra’s terms indicated that you need to comply with ICANN’s terms, and may have had a link to them. if not, google is your friend, you will find there is a procedure, outside of any court, for them to be asked to reassign infringing domain names. Any registrar on earth would comply with ICANN rulings.Fan sites are definitely an area where you could lose the domain - you think Disney will sit on letting someone have “Ilovemickeymouse.com”? they could petition ICANN at any time, and so could your favorite band.It is not really a lawsuit that is at issue unless you are making money, the first order of business would be via ICANN, and that is not a legal proceeding, nor strictly speaking is it a trademark dispute in front of ICANN.
