What would you call a generic “m&m” cookie?

Since M&M is actually a trademarked brand name, what would you call a cookie if it had similiar hard-shelled, candy-coated chocolates. Calling it an M&M when there are no “M&Ms” acutally involved woulld result in a possible lawsuit right? Just curious.rafjo86’s question about m&ms reminded me of this question..
